TERMS & CONDITIONS – ONLINE COURSE

These Terms and Conditions ("Terms") apply to all online courses ("Course", "Content") provided by Tam Walsh / Tamara Walsh ("we", "us", "our").

By purchasing, accessing, or using the Course, you confirm that you have read, understood, and agreed to be legally bound by these Terms.

1. ABOUT THE COURSE

The Course is a digital educational product delivered online. The Course is provided for educational and informational purposes only.

2. NO GUARANTEE OF RESULTS

We make no guarantees, representations, or warranties of any kind regarding outcomes, results, income, professional success, creative development, or suitability for any particular purpose. Any examples, demonstrations, or references provided are illustrative only and do not constitute promises or assurances of results.

Your outcomes depend on many factors beyond our control, including your skill level, experience, effort, and individual circumstances.

3. ELIGIBILITY

You must be 18 years or older to purchase or access the Course and legally capable of entering into a binding contract.

4. ACCESS & DELIVERY (updated)

Access to the Course is granted digitally after successful payment of the required amount (in full, or the first instalment where a payment plan is selected). Course content may be delivered in full or released on a scheduled basis (including drip-fed weekly lessons), as set out on the Course sales page. We reserve the right to update or amend Course content at any time.

5. PAYMENTS & REFUNDS (updated)

All prices are stated in GBP unless otherwise specified. Due to the digital nature of the Course, no refunds are available once access has been granted. By purchasing, you waive any statutory cooling-off rights.

Where a payment plan is selected, payment is taken in two instalments: the first at checkout, and the second one month later. Both instalments are required to complete your purchase, and access to the Course, community, and any live or 1:1 elements is conditional on instalments being paid on time. If any instalment payment fails or is not received, you will be locked out of the Course until payment is successfully made. Non-payment does not cancel your obligation to pay the remaining balance.

6. INTELLECTUAL PROPERTY & LICENCE

All Course content, including videos, demonstrations, written materials, techniques, and course structure, is protected by copyright and remains the exclusive intellectual property of Tam Walsh / Tamara Walsh.

You are granted a limited, non-exclusive, non-transferable licence to access the Course materials solely for your personal educational use.

7. THIRD-PARTY MATERIALS

Where third-party materials are referenced or displayed, no ownership is claimed. All third-party content remains the property of its respective rights holders.

8. ORIGINALITY & STUDENT RESPONSIBILITY

You agree to create original work and take full responsibility for how you apply techniques and ideas taught. Nothing in the Course grants permission to copy, imitate, or commercially exploit any identifiable work.

We do not provide legal advice regarding copyright or intellectual property compliance. Responsibility rests entirely with the student.

8A. TEACHING & COMMERCIAL USE OF THE METHOD (new)

You may not teach, demonstrate for instructional purposes, publish tutorials on, or otherwise create any course, class, workshop, guide, or paid or free instructional content — whether in person, online, or via social media — based substantially on the techniques, methods, or curriculum taught in this Course, without our prior written consent. This restriction applies whether or not you use our name, branding, or materials, and applies to both professional and personal social media use where the primary purpose is to instruct others in the method itself. This does not restrict you from sharing, discussing, or showcasing your own finished work made using skills learned in the Course.

9. LIMITATION OF LIABILITY

To the fullest extent permitted by law, we shall not be liable for any loss, damage, injury, or claim arising out of or in connection with your use of, reliance on, or inability to use the Course. This includes, without limitation, any direct, indirect, incidental, consequential, special, or economic loss, loss of profits, loss of opportunity, reputational damage, or personal dissatisfaction. You acknowledge that you use the Course at your own risk.

10. INDEMNITY

You agree to indemnify and hold harmless Tam Walsh / Tamara Walsh from any claims, losses, damages, liabilities, costs, or expenses arising from your use of the Course, breach of these Terms, or infringement of any third-party rights.

11. BREACH

Any breach of these Terms may result in immediate termination of access without refund and potential legal action.

12. GOVERNING LAW

These Terms are governed by the laws of England and Wales, and disputes shall fall under the exclusive jurisdiction of its courts.
